1. Scope and Definitions
These Terms and Conditions (“Terms”) apply to all purchases made through the online store https://www.maar-shop.com, operated by:

By placing an order, you agree to these Terms.
Customers are either consumers (purchasing for personal use) or business customers (purchasing for commercial purposes).
2. Contract Formation
(1) All product listings in our online store are non-binding and do not constitute a legal offer.
(2) By completing checkout and clicking “Place Order”, you make a binding offer to purchase the selected products.
(3) A contract is formed only when we confirm your order by email (“Order Confirmation”).
(4) We store your order details and send them to you along with these Terms by email. For security reasons, your past orders are not publicly accessible online.
3. Prices and Payment
(1) All prices are listed in euros (EUR) and include VAT for EU customers.
For customers outside the EU (e.g. United States, UK, Switzerland), VAT is not charged. However, import duties, taxes, or customs fees may apply in your country and are your responsibility.

(3) Payments are due immediately upon order confirmation.
4. Shipping and Availability
(1) All orders are shipped from Germany. Standard delivery times are 3–5 business days within the EU and 7–14 business days internationally (including the U.S.) after dispatch.
(2) If an item is not in stock, it will be ordered from the manufacturer after your purchase. In such cases, the preparation and shipping process may take up to 8 weeks. For certain products or supplier delays, the waiting time may be longer.
(3) We will contact the buyer after the order is placed to inform them about the expected delivery time and discuss any possible alternatives.
(4) If the manufacturer cannot supply the item, we reserve the right to cancel the contract. Any payments already made will be refunded immediately.
5. Retention of Title
All goods remain the property of Maar Handels GmbH until payment has been received in full.
6. Returns and Refund Policy
(1) EU customers are entitled to a 14-day right of withdrawal under EU consumer protection law.
(2) Non-EU customers (including the United States) may request a return within 14 days of delivery, in accordance with our store policy.
To qualify for a return, items must be:

unused and uninstalled,

in their original packaging,

with all labels attached, and
-
accompanied by proof of purchase.
(3) Return shipping costs are the responsibility of the buyer.

Unapproved returns will not be accepted.
7. Damaged or Defective Items
(1) Please inspect your order immediately upon receipt.
If the item is defective, damaged, or incorrect, contact us immediately with photos.
(2) Important: Once an item has been installed or used, we cannot accept returns or claims for factory defects, as installation prevents distinguishing between manufacturer and customer damage.
(3) Replacement or refund is only possible if the issue is documented before installation.
8. Non-Returnable Items
Certain types of products are excluded from return:

Installed or modified automotive parts
9. Warranty and Liability

Statutory warranty provisions apply.

Special products – RECARO/SPARCO seats: Professional installation in a certified workshop is mandatory. Installation must be documented with proof. If not followed, the warranty becomes void, and return of the seats is excluded.

For other products, standard warranty and return rules apply where legally permissible.
10. Governing Law and Jurisdiction
(1) All contracts are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) The place of jurisdiction for all disputes is Siegburg, Germany.
(3) For U.S. customers, this agreement does not affect any mandatory consumer rights under U.S. state or federal law.
